On the morning of November 21, the draft Law on Artificial Intelligence was officially presented to the National Assembly. This marks an important milestone in the development of Viet Nam’s legal framework for emerging technologies. It is the first time a dedicated law on AI has been submitted for review. The draft reflects the State’s commitment to ensuring safety, transparency and accountability in the deployment of AI systems.
The draft law outlines a clear system of penalties based on the nature and severity of violations. For general violations that are not part of Article 11, the maximum fine for organizations is VND 2 billion. For individuals, the maximum fine is VND 1 billion.
For serious violations under Article 11, penalties may be calculated based on the previous year’s revenue of the violating entity. Organizations may be fined up to 2 percent of their revenue generated in Viet Nam. In cases of repeated violations, the fine may reach 2 percent of global revenue.
This approach demonstrates Viet Nam’s effort to control risks associated with technologies that can have large scale impact. It also aims to create a transparent and sustainable competitive environment for technology enterprises.
The draft law introduces important requirements regarding transparency and user notification. In the context of increasing risks related to deepfake technologies, misinformation and online scams, organizations must provide clear identification of content produced by AI.
Organizations that develop or provide AI solutions have the responsibility to record and display transparent information whenever users interact with content created by AI. This applies in situations that may cause misunderstanding involving human likeness, real world events or activities related to communication and advertising. These requirements aim to reduce misuse of generative technologies and protect users in the digital information environment.
The draft law introduces a set of new compliance obligations for technology organizations. Enterprises that develop or deploy AI systems will need to review internal processes to ensure consistency with upcoming legal requirements.

As Vietnamese technology enterprises become more involved in AI development and application, the adoption of the Artificial Intelligence Law is expected to provide a stable legal foundation. It will encourage responsible innovation while safeguarding public interests and ensuring safety for users and communities.
